The moral standing of involuntary sterilization has long been subject to debate but has only recently been looked upon with disfavor. When sterilization of a mentally handicapped minor is entertained, issues of eugenics, medical ethics, and legal precedent specially arise. Ethics consultants and ethics committees have been asked to consider such cases.

This article aims to show how the changes to NEPA by the Trump Administration are an act of environmental racism, defined as “[i]ntentional or unintentional racial discrimination in environmental policy‐making, enforcement of regulations and laws, and targeting of communities for the disposal of toxic waste and siting of polluting industries.”.

The study of literary texts appears at the moment to stand at a decisive juncture. Trends in critical thinking over the last decades have questioned the possibility of recovering a text's historical meaning. At the same time, there is a newly insistent plea for a return to “history” in the interpretation of literature. Before a rapprochement can occur, however, we need to have a clearer understanding of how both historians and critics understand “history” and of the ways in which postmodernist (...) thought positions history and the role of the historian with respect to issues of literary interpretation at the forefront of contemporary critical debate. Current textbooks in formal semantics are all versions of, or introductions to, the same paradigm in semantic theory: Montague Grammar. Knowledge of Meaning is based on different assumptions and a different history. It provides the only introduction to truth- theoretic semantics for natural languages, fully integrating semantic theory into the modern Chomskyan program in linguistic theory and connecting linguistic semantics to research elsewhere in cognitive psychology and philosophy. As such, it better fits into a modern graduate or undergraduate program in (...) linguistics, cognitive science, or philosophy. Furthermore, since the technical tools it employs are much simpler to teach and to master, Knowledge of Meaning can be taught by someone who is not primarily a semanticist. Linguistic semantics cannot be studied as a stand-alone subject but only as part of cognitive psychology, the authors assert. It is the study of a particular human cognitive competence governing the meanings of words and phrases. Larson and Segal argue that speakers have unconscious knowledge of the semantic rules of their language, and they present concrete, empirically motivated proposals about a formal theory of this competence based on the work of Alfred Tarski and Donald Davidson. The theory is extended to a wide range of constructions occurring in natural language, including predicates, proper nouns, pronouns and demonstratives, quantifiers, definite descriptions, anaphoric expressions, clausal complements, and adverbs. Knowledge of Meaning gives equal weight to philosophical, empirical, and formal discussions. It addresses not only the empirical issues of linguistic semantics but also its fundamental conceptual questions, including the relation of truth to meaning and the methodology of semantic theorizing. This article investigates the differential structure and representation of time in memory and history. It examines two moments in Jewish historical thought--in the Middle Ages, and in works written within and after the Holocaust--and demonstrates the fundamentally liturgical nature of Jewish historical memory in selected texts from these two periods. Following the groundbreaking work of Yerushalmi, it seeks to demonstrate that for Jews, historical experience is incorporated into the cyclical reenactment of paradigmatic events in Jewish sacred ritual. Recent or contemporary (...) experiences acquire meaning only insofar as they can be subsumed within Biblical categories of events and their interpretation bequeathed to the community through the medium of Scripture, that is to say, only insofar as they can be transfigured, ritually and liturgically, into repetitions and reenactments of ancient happening. In such liturgical commemoration, the past exists only by means of recitation; the fundamental goal of such recitation is to make it live again in the present, to fuse past and present, chanter and hearer, into a single collective entity. History, in the sense that we understand it to consist of unique events unfolding within irreversible linear time, is absorbed into cyclical, liturgical memory.This article argues that the question of Jewish history--both medieval and post-Holocaust--poses in a compelling fashion the question of the relationship between memory and history more generally, and serves to contest the current tendency in academic historiography to collapse history into memory. It claims that to the extent that memory "resurrects," " re-cycles," and makes the past "reappear" and live again in the present, it cannot perform historically, since it refuses to keep the past in the past, to draw the line, as it were, that is constitutive of the modern enterprise of historiography. Public surveys conducted in many countries report widespread willingness of individuals to donate a kidney while alive to a family member or close friend, yet thousands suffer and many die each year while waiting for a kidney transplant. Advocates of financial incentive programs or “regulated markets” in kidneys present the problem of the kidney shortage as one of insufficient public motivation to donate, arguing that incentives will increase the number of donors. Others believe the solutions lie—at least in part—in facilitating (...) so-called “altruistic donation;” harnessing the willingness of relatives and friends to donate by addressing the many barriers which serve as disincentives to living donation. Strategies designed to minimize financial barriers to donation and the use of paired kidney exchange programs are increasingly enabling donation, and now, an innovative program designed to address what has been termed “chronologically incompatible donation” is being piloted at the University of California, Los Angeles, and elsewhere in the United States. In this program, a person whose kidney is not currently required for transplantation in a specific recipient may instead donate to the paired exchange program; in return, a commitment is made to the specified recipient that priority access for a living-donor transplant in a paired exchange program will be offered when or if the need arises in the future. We address here potential ethical concerns related to this form of organ “banking” from living donors, and argue that it offers significant benefits without undermining the well-established ethical principles and values currently underpinning living donation programs. Although transplantation surgeries are relatively successful and save the lives of many, only few are willing to donate organs. In order to better understand the reasons for donation or refusing donation and their implications on and influence by public policy, we conducted a survey examining public views on this issue in Israel. Between January and June 2010, an anonymous questionnaire based on published literature was distributed among random and selected parts of Israeli society and included organ recipients, organ donors, soldiers, (...) university and high school students, and the general population. The analysis of 799 questionnaires revealed that, although 74.7 percent have not signed a donor card, 60.8 percent of participants consider doing so. Additionally, 54.3 percent of respondents objected to giving or receiving compensation for donation, and, if at all, priority in transplantation care is the most desired form of such compensation. The health status of the donor and knowing that donation saves lives or that there exists a shortage of organs for transplantation are the two factors most affecting motivation to donate. Lack of information, relatives’ views on donation, and type of organ involved in donation are factors most inhibiting donation. Willingness to donate is significantly affected by the proximity of the recipient to the donor. With regard to most organs, their contribution to one’s sense of “self” and its symbolic role strongly affects motivation to donate, except for donation to relatives. Compensation for organ donation has little effect on motivation to donate during life and after death. Our findings suggest new ways to construct a more effective public policy on this issue. ABSTRACTThis essay reviews the recent book by Carolyn Dean that seeks to elucidate the ways in which complaints about a “surfeit of memory” and the privileging of Jewish victimization during the Holocaust as unique and as the emblem of radical evil in our times has shaped discussions of victims in general, creating an environment in which groups vie for victim status as a means of validating their grievances and making claims for justice. The hostility to such claims has, Dean argues, (...) created antivictim discourses that end up generating aversion toward victims, primarily by denying the validity of their claims to suffering and, in the case of Jews, projecting them as “perpetrators” in their neglect of the suffering of others. At the same time, Dean argues, the demand that victims narrate their suffering in the aesthetically constrained style of “minimalism” equally undermines the legitimacy of victims' memories by demanding that they be presented in an already mastered form, thereby erasing the very trauma that, in principle, such narratives seek to represent.At stake in the debates concerning Holocaust memorial consciousness and its proper modes of representation, this article suggests, are larger historiographical and ethical issues about how to integrate the horrors of the past and the traumatic experience of terror into the normal protocols of historical writing, which rely on distance, objectivity, and interpretive critique as governing procedures. To incorporate terror into historical representation will mean acknowledging and accepting as historiographically legitimate the differing status of analytically recuperated “facts” and victim testimony and finding a way to theorize the reality of “voices” from the past without assuming the necessary “truth” of what they convey. History, Theory, Text: Historians and the Linguistic Turn. By Elizabeth A. Clark.

While ethical and empirical interest in so-called secondary variants and incidental findings in clinical genetics contexts is growing, critical reflection on the ethical foundations of the various recommendations proposed is thus far largely lacking. We examine and critique the ethical justifications of the three most prominent disclosure positions: briefly, the clinical geneticist decides, a joint decision, and the patient decides. Subsequently, instead of immediately developing a new disclosure option, we explore relevant foundational ethical values and norms, drawing on the normative (...) and empirical ethical literature. Four ethical signposts are thereby developed to help guide disclosure discussions. These are: respectful sharing of the clinician’s expertise; transparent communication; epistemic modesty; and respect for the embedded nature of the patient. We conclude by considering the most common current disclosure positions in the light of the four ethical signposts. (shrink)

Disputations were a fixture of Martin Luther’s academic career. Luther participated regularly in disputations. It was an important communicative vehicle through which he developed and expressed his theology. The well-known 95 theses are a case in point. Luther’s career as a disputator was impressive. Several of his most influential disputations were explicitly intended for consideration by his academic and ecclesiastical colleagues, but the majority of his disputations took place as a curricular exercise at the University of Wittenberg. The purpose of (...) these disputations was pedagogical and polemical. Luther deployed the same tools for his defence of proper doctrine that were at the centre of the Protestant reformation in the face of objections. The disputatio de homine is a systematic summary of Luther’s anthropology. It incorporates the doctrine of justification as the theological definition of man. It treats the subject within the context of the relationship between theology and philosophy, and reflects upon the new language of theology. The disputatio de homine provides an essential resource for the study of Luther’s anthropology and the doctrine of justification. (shrink)

Pictorial representation is one of the core questions in aesthetics and philosophy of art. What is a picture? How do pictures represent things? This collection of specially commissioned chapters examines the influential thesis that the core of pictorial representation is not resemblance but 'seeing-in', in particular as found in the work of Richard Wollheim. We can see a passing cloud _as_ a rabbit, but we also see a rabbit _in_ the clouds. 'Seeing-in' is an imaginative act of the kind employed (...) by Leonardo’s pupils when he told them to see what they could - for example, battle scenes - in a wall of cracked plaster. This collection examines the idea of 'seeing-in' as it appears primarily in the work of Wollheim but also its origins in the work of Wittgenstein. An international roster of contributors examine topics such as the contrast between seeing-in and seeing-as; whether or in what sense Wollheim can be thought of as borrowing from Wittgenstein; the idea that all perception is conceptual or propositional; the metaphor of figure and ground and its relation to the notion of 'two-foldedness'; the importance in art of emotion and the imagination. Wollheim, Wittgenstein and Pictorial Representation: Seeing-as and Seeing-in is essential reading for students and scholars of aesthetics and philosophy of art, and also of interest to those in related subjects such as philosophy of mind and art theory. Public policy issues around access to networked information are explored and examined. Long viewed as the quintessential public good, information has evolved into a critically important market commodity in little more than a generation. New technologies and a political climate in which the meaning of universal access to information is no longer commonly understood and in which its importance is no longer taken for granted pose significant challenges for American society. Die proses het, in terme van geloof, begin met die formalisering van sowel die geloofsbegrip as die beskrywing van die inhoud van geloof. Dit is voortgesit deur 'n proses van die objektivering van die inhoud van geloof tot feite wat geleer kan word en is uiteindelik voltrek deur die implementering van 'n pragmatiese opvoedkundige doelwit waarin geloof (...) bloot 'n middel tot 'n doel geword het. Die trajek kan kortliks soos volg beskryf word: • Die Heidelbergse Kategismus Geloof is die aanneming van die beloftes van God wat vertroue in die lewende God skep. • 'Kortbegrip': Geloof is sekere kennis van God en sy beloftes en 'n hartlike vertroue dat al my sondes om Christus ontwil vergewe is. • Die belydenis van die Hervormers: Ek glo in God beteken dat ek al my vertroue op God stel en Hom op sy woord neem. • Geloofsleer: Geloof is kennis van die Woord van God en vertroue in die God van die Woord. • Geloof en Lewe 11: Geloof is die toe-eiening van kenbare geloofoorleweringe wat in die Bybel opgeneem is. Van Selms se kategismus pas nie in die trajek wat hier beskryf word nie. Gerhard Ebeling on faith. Gerhard Ebeling (1912–2001), not only the foremost Luther researcher of the previous century but also one of the most prominent contributors to protestant theology during that period, wrote extensively about faith throughout his long and productive life as a professional theologian. He learnt from Luther that discerning judgement in the differentiation of related matters forms the basis of all sound theology. Applying this insight to his own thought, he reflects on the development of the phenomenon of (...) faith in the Old Testament community and early Christianity and the formalisation of the concept for use in the domain of religious studies. He defends the argument that Christian faith is not only faith in Jesus as the Christ and Lord but also that Jesus, and He only, is the founder and perfecter of faith. The concept of faith is also explored by Ebeling in relation to love, life and reason. The article concludes with a critical evaluation of Ebeling’s contribution in guiding us to witness authentically about our own faith in Jesus Christ within our own situation and against the background of the problems it poses for believing in Christ. Rudolf Bultmann was one of the leading thinkers within an influential theological direction that arose in Europe after the First World War, known as dialectical theology. Comprehensive introductions to the life and work of Bultmann in the South African theological journals, written in Afrikaans, either does not exist, or are difficult to trace for the Afrikaans readership. This article on Bultmann aims to fill the gap by offering a lexicographical contribution on the life and work of Bultmann. The focus of (...) this article is on Bultmann as a Lutheran thinker. The theme of the New Testament and systematic theology is essentially the same, namely to explain the concept of Christian self-understanding as an eschatological event in which faith is expressed for the sake of faith in God and only in God. Bultmann explained the same theological concepts with his theology as those that were explained by the church reformers of the 16th century, but under radically new circumstances. The so-called modern and postmodern people of our time not only broke ties with the past, but in the process they also lost their ability for using historical-critical patterns of thought that tries to bridge historical distances, and therefore sacrificed all efforts to think systematically on the altar of relativism. We can learn from Bultmann what systematic reformed theology really is. (shrink)

The gospel is not a new law. A clear distinction must be made between law and gospel, so that the gospel is not mistakenly understood as a new law, but as the gospel. The relationship between law and gospel must be considered carefully. Two prominent theologians, Martin Luther and Karl Barth, did just that, but in opposition to one another. This article describes and compares their respective views. Barth defends a political use of the gospel. The gospel provides believers with (...) action instructions for the civilian life. Barth argues in terms of analogical thinking and, according to him, believers’ understanding of reality is determined by their understanding of Christ. Luther, on the other hand, believes that the preaching of Christ and the life experience are in contrast. Faith and life are not identical. He understands the believer as the hearer of the gospel – as passive recipient of the grace of God. The passivity here, however, is a highly creative one. The relevance for us of the theological position defended regarding law and gospel is evident from the document ‘Association of the World Communion of Reformed Churches with the Joint Declaration on the Doctrine of Justification’. The spirit of the document is clearly Barthian. Fundamental theological differences are on the table with the Lutheran position and there is no question of real consensus. Intensive study and frank ecumenical conversation is required to seek real consensus for the sake of a clear Christian testimony in the world. (shrink)

The distinction between the force/mode of speech acts and intentional states and their propositional content has been a central feature of analytic philosophy since Gottlob Frege and Bertrand Russell. In this introduction we present the distinction and its motivation and review some recent challenges to it that appeal to the problem of the unity of the proposition, in order to give the reader a sense of the current state of debate to which the contributions of this volume respond.

We describe the parallel changes that have taken place in recent years in two countries, Israel and The Philippines, the former once an “exporter” of transplant tourists and the latter once an “importer” of transplant tourists. These changes were in response to progressive legislation in both countries under the influence of the Declaration of Istanbul. The annual number of Israeli patients who underwent kidney transplantation abroad decreased from a peak of 155 in 2006 to an all-time low of 35 in (...) 2011 while in the Philippines the annual number of foreign transplant recipients fell from 531 in 2007 to two in 2011. The experience of these two countries provides a “natural experiment” on the potential impact of legal measures to prevent transplant tourism. (shrink)
